Welcome to Parihar Photography. These Terms & Conditions govern your use of our website, services, and any photography-related engagements with us. By booking our services or using our website, you agree to abide by these terms.

Parihar Photography is a professional photography service based in Rampur, Uttar Pradesh, India, owned and operated by Viksit Parihar.

2. Booking and Confirmation

2.1 Booking Process

All bookings must be made through our official channels — website, phone, email, WhatsApp, or in-person consultation. A booking is considered confirmed only after:

  • Receipt of the advance payment
  • Written or verbal confirmation from Parihar Photography
  • Agreement on event date, services, and deliverables

2.2 Advance Payment

A non-refundable advance payment is required to secure your booking. The advance amount will be discussed and agreed upon during the consultation phase.

2.3 Balance Payment

The remaining balance must be paid on or before the event date, unless otherwise agreed upon in writing.

3. Service Scope and Deliverables

3.1 Services Offered

We provide professional photography services including but not limited to:

  • Wedding Photography
  • Pre-Wedding Shoots
  • Bridal Photography
  • Portrait Sessions
  • Event Coverage (Birthdays, Anniversaries, Corporate Events)
  • Maternity & Newborn Photography
  • Candid Photography
  • Cinematography & Videography

3.2 Deliverables

Specific deliverables (number of edited photos, albums, videos, etc.) will be clearly outlined in your booking agreement. Standard delivery timelines:

  • Wedding Photos: 3-4 weeks after the event
  • Pre-Wedding Shoots: 1-2 weeks
  • Albums (if applicable): 4-6 weeks after final selection

3.3 Editing Style

All photographs are edited in our signature style, ensuring consistency and quality. Major edits, theme changes, or re-editing beyond the agreed scope may incur additional charges.

4. Client Responsibilities

By engaging our services, the client agrees to:

  • Provide accurate event details (date, time, venue, schedule)
  • Ensure timely access to event venues for our team
  • Inform us of any special requirements, restrictions, or sensitive moments
  • Make timely payments as per the agreed schedule
  • Provide meals and refreshments for our team during long shoots (where applicable)
  • Cooperate with our team for smooth execution of the shoot

5. Copyright and Usage Rights

5.1 Copyright Ownership

All photographs and videos produced by Parihar Photography are protected by copyright laws. We retain the copyright for all photographs and videos captured during our services.

5.2 Client Usage Rights

Clients are granted a personal, non-commercial license to use the photographs for:

  • Personal display and printing
  • Sharing on personal social media accounts
  • Family albums and keepsakes

5.3 Commercial Use

Any commercial use of the photographs (advertising, brand promotions, third-party publishing, sale, etc.) requires prior written consent from Parihar Photography and may involve additional licensing fees.

5.4 Our Usage Rights

Parihar Photography reserves the right to use photographs from your event for:

  • Portfolio display
  • Website and social media promotion
  • Marketing materials
  • Submissions to photography competitions and publications

Unless the client explicitly requests otherwise in writing.

6. Cancellation and Refund Policy

Cancellation and refund terms are governed by our separate Refund & Cancellation Policy. Key points:

  • Cancellations must be made at least 7 days before the event date
  • Advance payments are strictly non-refundable
  • Rescheduling is allowed once per booking (subject to availability)

7. Rescheduling

  • Rescheduling requests must be made at least 7 days before the original event date
  • One free rescheduling is allowed per booking
  • Subsequent rescheduling may incur additional charges
  • Rescheduling is subject to our availability on the new date

8. Force Majeure

Parihar Photography shall not be held liable for any failure to perform services due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters (floods, earthquakes, storms)
  • Pandemics or government-imposed restrictions
  • Civil unrest or political instability
  • Severe weather conditions
  • Medical emergencies of team members
  • Equipment failure or technical issues despite reasonable precautions

In such cases, we will work with the client in good faith to reschedule the event or provide an alternative solution.

9. Liability and Indemnification

9.1 Limitation of Liability

Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for that specific service.

9.2 No Liability For:

  • Indirect, incidental, or consequential damages
  • Loss of memories due to circumstances beyond our control
  • Equipment failure during shoots (despite reasonable precautions)
  • Issues caused by third-party vendors

9.3 Indemnification

The client agrees to indemnify and hold harmless Parihar Photography from any claims, damages, or liabilities arising from:

  • Misuse of delivered photographs/videos
  • Disputes with third parties
  • Inaccurate or misleading information provided by the client

10. Photo Loss and Backup

While we take every precaution to safeguard your photographs (multiple backups, cloud storage, encrypted drives), in the rare event of unforeseen data loss before delivery, our liability is limited to a refund of the service fee paid.

We strongly recommend clients keep their delivered photos backed up after receipt, as we retain delivered files for only 6 months post-delivery.

11. Quality and Satisfaction

11.1 Our Commitment

We are committed to delivering high-quality photography that reflects our signature style and creative vision.

11.2 Client Disputes

If you have any concerns about the delivered work, please contact us within 15 days of receiving the final deliverables. We will make reasonable efforts to address genuine concerns through:

  • Re-editing of specific photographs
  • Additional retouching where applicable
  • Other reasonable remedies

However, since photography is a subjective creative service, refunds will not be issued for completed and delivered work based on personal taste or preferences.

12. Behavior and Conduct

We expect respectful and professional conduct from all clients and their guests during shoots. We reserve the right to terminate services without refund if our team faces:

  • Verbal or physical harassment
  • Discriminatory behavior
  • Unsafe working conditions
  • Demands beyond the agreed scope

13. Website Use

13.1 Permitted Use

You may use our website for personal, non-commercial purposes only. You may not:

  • Copy, reproduce, or distribute any content without permission
  • Use our images, text, or design elements for commercial purposes
  • Attempt to hack, disrupt, or harm our website
  • Use automated tools to scrape data

13.2 Intellectual Property

All content on our website (text, images, design, logos) is the intellectual property of Parihar Photography and is protected by Indian and international copyright laws.

14. Communication

By providing your contact information, you consent to receive communications from us via:

  • Phone calls
  • SMS / WhatsApp
  • Email

15. Changes to Terms

16. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts located in Rampur, Uttar Pradesh.

17. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
